It’s Over

In an amazing display of sanity, fairness, and common sense, the judge in megabuck missing pants trial has told the plaintiff to pay the legal costs of the defendants, take his pants, and get out of her sight [or something very close].

The only thing missing was a mental health referral that the plaintiff really needs.

Hmm. I seem to remember having been told that, but I was much, much younger at the time, and there was no lawsuit pending…

That was the silliest lawsuit I’ve ever read about. At first, I thought I’d see a notice in a day or so that the whole thing was a hoax. I hope and presume the fellow is no longer on the bench, with or without his pants.

I think they have to impeach or recall him, depending on how he came to the bench, to get rid of him, and the trial judge presented a lengthy decision, most probably because she expects an appeal.

This will probably become the new “poster case” for tort reform.

Tort reform? It sounds to me as if the trial judge took care of matters just fine, as most judges surely would have done. We don’t need draconian legislation. But you’re right, Bryan: this case will surely appear out of the mouths of GOP shills for some time to come.

Most lawsuits are anything but “frivolous” to those who file them, and most judges can weed out the few problem cases like this one. I don’t want to see legitimate lawsuits against, say, wayward corporations inhibited by laws that limit people’s legitimate access to the courts.

If the guy hadn’t been a judge, the case would have never made it to trial. It would have disappeared at the preliminary motion to dismiss by the defense.

Tort reform has never done anything about the insurance problems or the log jam in courts, but that doesn’t stop the cons from pushing it.

At least common sense prevailed in the end. Pearson may have lost his trousers now he may lose his shirt too..
