I didn’t like it when Clinton did it, and it needs to be altered, but it will take a Constitutional amendment. The need for a recess appointment disappeared when Congress became a full-time job, and not an obligation during the slow period on the farm.

Apparently there are also legal problems (over and above the constitutional ones) about the SwiftBoater’s appointment. Federal law requires that certain kinds of recess appointments have to be unpaid, and Mr. Fox (a multimillionaire, natch) volunteered to accept the ambassadorial appointment without salary. But federal law also prohibits appointing someone without pay to any position that has a fixed salary, as ambassadors do.

Seems that Bush can’t even manage to slide his wingnuts in quietly without shooting himself (and them) in the foot.

Bush has two eyes. The Senate has 200 eyes altogether, many of them belonging to bright, powerful people. If Bush is going to start shoving metaphorical sticks in the eyes of Senators, he’d better have not only a large supply of sticks, but a really good pair of protective goggles.

Don’t wait for the end of his term. Impeach the bastard now.
