It would have disappeared at the preliminary motion to dismiss by the defense.

Tort reform has never done anything about the insurance problems or the log jam in courts, but that doesn’t stop the cons from pushing it.

It sounds to me as if the trial judge took care of matters just fine, as most judges surely would have done. We don’t need draconian legislation. But you’re right, Bryan: this case will surely appear out of the mouths of GOP shills for some time to come.

Most lawsuits are anything but “frivolous” to those who file them, and most judges can weed out the few problem cases like this one. I don’t want to see legitimate lawsuits against, say, wayward corporations inhibited by laws that limit people’s legitimate access to the courts.

This will probably become the new “poster case” for tort reform.

Hmm. I seem to remember having been told that, but I was much, much younger at the time, and there was no lawsuit pending…

That was the silliest lawsuit I’ve ever read about. At first, I thought I’d see a notice in a day or so that the whole thing was a hoax. I hope and presume the fellow is no longer on the bench, with or without his pants.
