These days most violations involve using government resources: infrastructure, facilities, equipment, etc., rather than employees. There are two separate phone systems in most governent offices of elected officials, one for government business and the second for fund raising. The normal level of compliance is really amazing.

Good point about the Hatch Act preventing them from using the resources of their office to go politicking, because those resources are themselves covered by the Hatch Act.

Actually those appointees do fall under the jurisdiction of the Hatch Act and cabinet secretaries and Vice President Al Gore have all run afoul of the act. The key is whether or not the individual used the power of their office. They can’t take an official action to assist their preferred candidate or impede the opponent.

Just a reminder: the Hatch Act does not apply to political appointees in the executive department (those appointed by the President with the Advice and Consent of the Senate). They are assumed to be political and can campaign as they wish. However, it’s rather bad form to campaign *against* the candidate that your President supports!

Comey may have violated Federal law by his actions in this case. We know and he admits that he has violated Justice Department policy and proedures. Given that they didn’t get a warrant to look at the e-mails until after he made his announcement, the FBI has no idea if there is anything related to Hillary Clinton on Weiner’s laptop. If there is nothing on the laptop, Comey is unemployed and possibly facing charges under the Hatch Act for engaging in politics.
