It is the grand jury that issues indictments, and they can indict nyone they want. Prosecutors may no want to pursue the case, but there is nothing in the law or Constitution that prevents a President from being indicted. Yes, it would go to the Supreme Court, but it can happen, regardless. Mueller won’t seek the indictment, and it won’t be pursued while a President is in office.

If he fires Mueller, the Gop will lose the Senate as well as the House and the hearings will begin in earnest.

Everybody around him, yes. Trump himself, no. That would set up one heckuva Constitutional crisis.

As far as the midterms go, firing Mueller right now would basically give the midterms to the Democrats. Supposedly Trump has been howling at everybody in the Justice Department to fire Mueller, while everybody around Trump is saying no, no, no, it would be political suicide. So yeah, Trump may be right that Mueller gives the midterm to the Democrats. If he fires Mueller, that’s pretty darn certain.

What exactly is Mueller going to do? At most he could issue an indictment of Trump, but Trump couldn’t be tried until after leaving office. Some people claim that you can’t indict a sitting President, but no one has tested that claim in court. Currently it is Department of Justice policy not to indict the President, but a grand jury could do it, if it wanted to.

The Republicans are in deep yogurt and know it, which is why so many are retiring rather than spending money to lose. The people who can win a Republican primary, aren’t sane enough to win the general election. In six months we’ll see what happens.
